PDP, Adebutu Withdraw Application For Stay of Execution
The Peoples Democratic Party and Hon. Oladipupo Adebutu on Thursday, 13th October, 2022 moved for the withdrawal of the separate applications earlier filed for a stay of Execution of the two judgements delivered by Justice O. O. Oguntoyinbo on Tuesday, 27th September, 2022 respectively calling for a fresh primary elections of the Gubernatorial and other Candidates within 14 days from the date of judgement.
The application described as a waste of time of the court and which has become mere academic exercise because the 14 days ordered by the court for a fresh election expired on 12th October, 2022 while the appeal processes of same judgements are on-going progressively.
In the submission of PDP and Hon. Oladipupo Adebutu, through their Counsel, Barrister Muyiwa Obanewa argued that “the withdrawal, in view of the fact that the party has filed an appeal against the judgement of the Federal High Court ordering the State Exco to conduct a fresh primary within 14 days”.
“The initial application for a stay before the federal high court has completely become a mere academic exercise given the fact that the 14 days elapsed on 12th October and no fresh primary was conducted because the judgements are already been appealed” Obanewa argued.
The judgements in the two suits filed by Taiwo Olabode & 2 others on one part and Prince Segun Seriki were respectively delivered on 27th September, 2022 at the federal high court sitting in Abeokuta.
